Terms of Use

The terms on which you may access and use the Temp°IQ™ Research Repository. By entering or using the Site, you agree to these terms.

This Research Repository (the "Site") is a confidential, credentialed publication of Temp°IQ's thermal research.

1. Acceptance

By accessing the Site you agree to these Terms of Use and to our Privacy Policy. If you do not agree, do not use the Site. If you use the Site on behalf of an organization, you represent that you are authorized to bind that organization.

2. Access and credentials

Access is by invitation and is granted through a passphrase shared with your study or partner group. Credentials are for your or your group's use as intended; please do not share them outside that group or attempt to reach areas you were not granted. We may change, suspend, or revoke access at any time.

3. Confidentiality

Materials on the Site — including white papers, study designs, protocols, and discussions — are confidential and provided for evaluation and collaboration. You agree not to copy, distribute, publish, or disclose them outside your authorized group without our written permission.

4. Not medical advice

The Site is informational and is descriptive, not diagnostic. Content does not constitute medical, clinical, or professional advice, does not create a clinician–patient relationship, and is not a substitute for the judgment of a qualified professional. Clinical decisions remain with the treating clinician.

5. Research and forward-looking content

Much of the content describes research in progress, proposed studies, and hypotheses. Statements about devices or methods are not claims of safety or efficacy, are sized to the evidence available, and may change. Consumer cooling framing is non-FDA; medical framing changes the regulatory line. Nothing here is a treatment claim or an offer of a medical device.

6. Intellectual property

The Site and its content are owned by Temp°IQ or its licensors and are protected by intellectual-property laws. We grant you a limited, revocable, non-transferable license to view the content for the permitted, internal evaluation purposes only. All other rights are reserved.

7. Acceptable use

You agree not to misuse the Site — including by attempting to bypass access controls, scraping or bulk-downloading content, probing or testing security, introducing malicious code, or using the Site unlawfully or in a way that harms its operation or other users.

The forum and other interactive areas are open for reading to credentialed members; posting is by invitation. If you post, you agree to the forum code of conduct, which forms part of these terms. We may edit or remove posts, and suspend or revoke posting access, for conduct that breaches the code or these terms.

8. Your submissions

If you submit content (for example through the forum or the Participate form), you are responsible for it, you grant us a license to use it to operate the Site and the research program, and you agree not to submit personal health information, patient data, or anyone else's confidential information.

9. Third-party links

The Site links to third-party sites, including tempiq.com. We are not responsible for their content or practices; your use of them is governed by their own terms and policies.

10. Disclaimers

The Site and its content are provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy, and non-infringement, to the fullest extent permitted by law.

11. Limitation of liability

To the fullest extent permitted by law, Temp°IQ and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss arising from your use of or inability to use the Site.

12. Indemnification

You agree to indemnify and hold harmless Temp°IQ and its affiliates from claims arising out of your misuse of the Site or breach of these terms.

13. Governing law

These terms are governed by the laws of the State of New York, without regard to conflict-of-laws rules, and disputes will be resolved in the state or federal courts located in New York, New York.

14. Changes

We may update these terms from time to time. Continued use after changes means you accept the updated terms; we will revise the "Last updated" date above.
